Operator Agreement

This Operator Agreement ("Agreement") is between FoodTrucksMove.com ("FoodTrucksMove," "we," "us," or "our") and you, the food truck owner or authorized representative ("Operator," "you," or "your") who creates or manages a truck listing on FoodTrucksMove.com (the "Service"). By creating, claiming, or managing a listing, you agree to this Agreement. This Agreement is in addition to our Terms of Service and Privacy Policy, which also apply to you.

1. Who Can Be an Operator

To manage a listing, you must be the owner of the food truck or a person authorized to act on the owner's behalf. By claiming or managing a listing, you represent that you have that authority. You must be at least 18 years old, or the age of majority in your location, to enter into this Agreement.

2. Your Listing

We give you the ability to create and maintain a listing for your food truck, which may include your truck's name, location, hours, menu, images, description, and contact links. Your listing helps people find and visit your truck.

You control the content of your listing, and you are responsible for keeping it accurate and reasonably current. We are not responsible for outcomes that result from outdated or inaccurate listing information you provide.

3. Your Responsibilities

As an Operator, you agree to:

  • Provide accurate, truthful, and current information about your truck, including location, hours, menu, and pricing;
  • Update your listing when your location, hours, or availability change, so the people relying on it are not misled;
  • Operate your business lawfully, including holding all required licenses, permits, and health certifications, and complying with all applicable food-safety and local regulations;
  • Only claim or manage listings for trucks you own or are authorized to represent;
  • Submit only content you own or have permission to use, including images;
  • Respond honestly and professionally to customers who contact you through the Service;
  • Keep your account credentials secure and not share them with unauthorized people.

4. What You Agree Not to Do

You agree that you will not:

  • Post false, misleading, or fraudulent information about your truck or anyone else's;
  • Impersonate another business or claim a listing you are not authorized to manage;
  • List a location where you are not actually operating, or "check in" to places to mislead customers;
  • Post content that is unlawful, infringing, defamatory, obscene, or harassing;
  • Use the Service to spam, harvest data, or send unsolicited messages to other users;
  • Attempt to manipulate rankings, featured placement, or search results through dishonest means;
  • Interfere with the Service, attempt to gain unauthorized access, or use bots or scrapers without our permission;
  • Use the Service in any way that harms other operators, customers, or FoodTrucksMove.

5. License to Your Content

You keep ownership of the content you submit. By submitting it, you grant FoodTrucksMove a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content for the purpose of operating, improving, and promoting the Service - for example, showing your listing to customers or featuring trucks in promotional materials. This license ends when you remove the content or your listing, except for copies retained in routine backups or as required by law.

6. How We Treat Your Information

We will treat your information reasonably and in line with our Privacy Policy. Specifically:

  • We will use the information you provide to operate the Service, display your listing, communicate with you, and improve the platform.
  • We will not sell your personal information.
  • Information you put in your public listing (such as truck name, location, hours, and images) is shown publicly. Account details that are not part of your public listing, such as your email address, are not published by us as part of your listing.
  • We will share information with service providers only as needed to run the Service (for example, hosting, email delivery, analytics, and payment processing), and with the protections described in our Privacy Policy.
  • We will take reasonable measures to protect your information, though no system can be guaranteed completely secure.

7. Fees and Paid Features

Creating a basic listing is provided at no cost unless we state otherwise. Optional paid features, such as advertising or featured placement, are subject to the pricing and terms presented at the time of purchase and are handled through our third-party payment processor. We may change the availability or pricing of paid features, and we will make current pricing available before you purchase.

8. No Guarantee of Results

We provide a platform to help customers find your truck, but we do not guarantee any particular level of visibility, traffic, customers, or sales. Listing on the Service does not constitute an endorsement or certification of your truck by FoodTrucksMove.

9. Moderation and Enforcement

We may review, edit, or remove listings or content that we believe violate this Agreement, our Terms of Service, or applicable law, or that are inaccurate or misleading. Where reasonable, we will try to let you know and give you a chance to correct an issue, but we are not required to do so. We may suspend or remove a listing or account that repeatedly or seriously violates this Agreement.

10. Suspension and Termination

You may stop using the Service and remove your listing at any time. We may suspend or terminate your access or listing if you violate this Agreement or our other policies, if required by law, or if we reasonably believe your conduct harms the Service or other users. Sections that by their nature should survive termination - including content licenses already granted, disclaimers, and limitations of liability - will continue to apply.

11. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available." To the fullest extent permitted by law, FoodTrucksMove disclaims all warranties and will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or business, arising out of your use of the Service. Our total liability to you for all claims relating to the Service will not exceed the greater of the amount you paid us for paid features in the prior twelve months or one hundred U.S. dollars ($100). These limits are part of the basis on which we offer the Service.

12. Indemnification

You agree to indemnify and hold harmless FoodTrucksMove from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your listing, your content, your business operations, or your violation of this Agreement or any law or third-party right.

13. Changes to This Agreement

We may update this Agreement from time to time. When we do, we will revise the "Last updated" date above. Significant changes may be communicated through the Service. Your continued use of the Service or maintenance of a listing after changes take effect means you accept the updated Agreement.

14. Governing Law

This Agreement is governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Florida.
